Widow of Driver in Paul Walker Fatal Crash Files Lawsuit Against Porsche

The widow of the driver who was killed along with actor Paul Walker in a fatal car accident, has filed a lawsuit against Porsche, alleging that defective mechanics ultimately caused the fiery crash.

Kristine Rodas, wife of Roger Rodas, an El Salvador native who was driving the vehicle, filed the lawsuit in the Los Angeles County Superior Court on Monday.  According to the complaint, Miss Rodas asserts that the 2005 Porsche Carrera GT failed to have an appropriate crash cage and lacked proper safety features in the gas tank that would have saved the lives of both victims.

The “fuel cell” is found in many race cars and prevents the fuel from igniting should a crash occur. According to the legal documentation, the Porsche Carrera did not contain this life-saving device.

The vehicle’s suspension system was also called into question in the lawsuit,which contends the system is responsible for causing the car to veer out of control and strike three trees while driving down a street in Santa Clarita, Calif.

“The Carrera GT was unsafe for its intended use by reason of defects in its manufacture, design, testing, component and constituents, so that it would not safely serve its purpose,” states the lawsuit, which seeks unspecified damages from Porsche Cars North America.

Attorney, Mark Geragos, who is representing the Glendale mom of two, hired his own team of investigators to evaluate the wreckage and the accident scene.  Geragos’ investigative unit, strongly refutes the allegation that the vehicle was traveling at speeds of 94 mph at the time of the collision.

According to inquiry results released by the Los Angeles County Sheriff’s Department and California Highway Patrol, it is their assertion that speed was a significant factor, rather than faulty mechanics, in causing the deadly accident. Porsche also had their team of engineers participate in the investigation as well as the evaluation of the wreckage.

The fitness instructor and health club manager lists negligence, wrongful death and product liability according to the lawsuit adding that her husband, Roger Rodas, had extensive training as a race car driver. Miss Rodas is insisting on a jury trial.

As the time of his untimely death, Paul Walker was in the middle of filming the Fast & Furious 7. Universal Studios has recruited Cody and Caleb Walker to step in for their deceased brother, as they wrap up shooting some of the action sequences for the movie.

The film is due to be released April 10, 2015.
